Bullying Policy

O.J.U.S.D. Procedures for the Enforcement of Bullying Policy 5131.2

 
Oakdale Jt. Unified School District Board Policy 5131.2 states: District Employees shall not tolerate bullying, and no student or group of students shall, through physical, written, verbal, or other means, harass, sexually harass, threaten, intimidate, cyber-bully, cause bodily injury, or commit hate violence against any other student or school personnel. The District believes that all students have a right to a safe and healthy school environment.  All members of our school community (principals, vice principals, teachers, students, parents, and other staff) have an obligation to promote mutual respect, tolerance, and acceptance.
 
The purpose of this procedure is to consistently enforce the steps staff and administrators will take when someone is bullied or harassed.  A quick, consistent, and appropriate response will help our schools rid themselves of bullying and harassment so that every student feels safe (both physically and emotionally) at their school.
 
This policy applies to students on school grounds, while they are traveling to and from school or a school-sponsored activity off-site, during the lunch period, and during a school-sponsored activity.
 
PROCEDURE:
  1. What should staff do when they encounter bullying and/or harassment?
  • Immediately intervene:. Assembly Bill 9 requires school personnel who witness an act of discrimination, harassment, intimidation, and/or bullying to take immediate action and to intervene when safe to do so.
  • Promptly investigate:  Follow any report of bullying and/or harassment. Get as much information as possible upon witnessing an incident or receiving information or a report of bullying.
  • Immediately report incidents of bullying to the principal or designee. 
 
  1. What should students do when they encounter bullying and/or harassment?
  • Immediately report the incident to the supervising staff.
  • Focus positive attention on the target not the bully.
 
  1. The site administrator shall investigate the incident and come to a finding of facts in accordance with Due Process investigative and determination procedures.
 
  • Any student which is found to have committed an act of Bullying/ Harassments is subject to disciplinary action in accordance to the Student Code of Conduct.
    AWARENESS AND NOTIFICATIONS:
    To ensure that bullying incidents are handled in accordance to Board Policy,  Oakdale Jt. Unified School District will provide annual training by means of at least one of the following::
     
  • Site Administration will review this policy/ procedure at a staff meeting at the beginning of each school year, and will investigate the feasibility of including Bullying Awareness and Reporting Procedures at an assembly or during a classroom presentation.
  • Bullying Intervention procedures information/ training provided to all staff within the first month of school. (Classified staff, coaches, after school care providers, and coaches may also be included in this training.)
  • Parents will be reminded of this policy annually in at least one of the following ways:
  • Mandatory Parental Notifications in 1st day packet or/ Parent Handbook
  • Review at Back to School Night
  • District Newsletter
  • Policy posted on school’s website
  •  
    If the complainant student or the parent of the student believes that the investigation or complaint was not resolved appropriately, the student or the parent of the student should contact the Principal. 
     
    The Oakdale Joint Unified School District prohibits retaliatory behavior against any complainant or any participant in the complaint process
